A magistrate judge says D.C.'s federal court is disturbed by the high rate of dismissals in felony cases since August.

D.C.s federal court is growing increasingly concerned over the number of felony cases being charged and then swiftly dismissed, a magistrate judge warned Tuesday.
Magistrate Judge Matthew Sharbaugh said his staff had counted at least 11 cases U.S. Attorney Jeanine Pirros office had sought to dismiss since the federal surge began in D.C. last month. All of those cases involved alleged assaults on federal officers.
It sems like one takeaway could be the government is filing these charges and investigating them afterward, Magistrate Judge Matthew Sharbaugh said. Thats not how its supposed to work.
While federal prosecutors do sometimes move to dismiss cases after a review of the evidence, its rare. Only 6.5% of federal cases filed last year ended in dismissal, according to data maintained by the Administrative Office of the U.S. Courts. Federal assault cases were dismissed at an even lower rate of roughly 2.5%......
Sharbaugh, one of four magistrate judges who signs arrest warrants and handles initial hearings for D.C.s federal court, isnt the first judge in the district to express worries. Another magistrate, Magistrate Judge Zia M. Faruqui, blasted Pirros office earlier this month for asking him to dismiss the case against a man it had accused of threatening to kill Trump after it failed to secure an indictment. In that and other cases, Faruqui has accused prosecutors of failing to treat defendants with human dignity.
Sharbaugh was more reserved Tuesday, but said the track record of Pirros office in felony assault cases over the past month wasnt good.
