Conservative Supreme Court Justice Clarence Thomas was taken to task on Tuesday over his non-legalistic claims in a ruling that allows states to bar transgender female athletes from participating on girls and womens sports teams.
In the 6-3 decision for the conservative majority Justice Brett Kavanaugh took the lead and wrote that schools "may determine eligibility for women's and girls' sports based on biological sex."
"Separate sports teams for biological males and biological females are reasonable," he added.

Note - these are remarks from Justice Thomas remarks, not from me. (I am amazed that this was necessary.)
The headline: "'Vile man': Justice Clarence Thomas bashed for 'ugliest' remarks in major new ruling"
Yet the OP did not include the remarks by Thomas. I added them - "the actual remarks" - to save people from needing to go to Rawstory.
Because gender dysphoria is a mutable mental state that is the object of psychiatric treatment, it does not resemble the immutable characteristics on the basis of which our precedents have applied heightened scrutiny race, sex, or national origin. Second, as the Court recognizes, this case concerns biological men and boys who identify as girls. Men and boys with gender dysphoria are not women or girls, even if they believe that they are."

(4,253 posts)It happens too often that the headlines for an article and the excerpts from the article selected for posting are completely unrelated. It isn't really "general discussion" if we are just being sent to other sites. Why should DU function merely to help sites like RawStory increase their ad revenue? Are we just a feeder, funneling people into social media platforms and clickbait sites?

His horrible comments all the way along the abortion dispute, from Roe v Wade to Dobbs v Jackson Women's Health. Yet, so much surprise at his comments today toward trans athletes and trans people in general...
And, yet, there is surprise at the dehumanizing attitude toward trans people? Really? Given he thinks women are not even approaching men in equality and would undoubtedly vote to overturn the 19th amendment if given enough years on the court and the right case, I am a bit incredulous that he continues to be given benefit-of-the-doubt. Of course there were never the overwhelming alliances for women's rights--including abortion, that should have been there over the decades, with many (not all) thinking it was a "woman's issue" and thus their fight to bear. Well, is this going to be the way of the future with minority rights? "They" are on their own? Whether trans people, LGBQ people, immigrants or women. None of us is equal in the minds of someone like Thomas, whose own features that would make him unequal in the minds of many white men everywhere does not even register with him.
And the final irony--my disdain for Clarence Thomas--much deserved and earned--would undoubtedly have me on the receiving end of RW claims of "racism" if I ever uttered them loudly and publicly or stated such at his retirement or funeral.
This country will celebrate a few of these decisions and the MSM will focus on the "rational" ones. But there is real damage from the others, including the gift case to Trump that all but eliminates the power of independent agencies to protect the public against a willful tyrannical authoritarian President (Trump vs Slaughter).

Indeed, conservatives have long engaged in unwarranted attacks on transgender Americans, seeking to disadvantage and discriminate against them.
