Maybe just maybe one of those intensely racist border officials isn't a fan of miscegenation (Loving v Virginia, notwithstanding) and questions the validity of their passports and other documents thus refusing entrance back to the US. 2. He needs to stay or hold the seat stay empty until the next Congress gets sworn in.

(1,481 posts)If either Thomas, Alito, or both resign and Democrats control the Senate in 2027 or 2028, then the Democrats could invoke the McConnell Rule in not letting a sitting presided to appoint a SC Justice at the end of his term.

(4,160 posts)They have already forced our hand on expansion as far as I see it back in '01 but that's gonna be tough. We really need an Obama level wave in '28. I believe if they cram 1 or 2 through they will also be young so if we have the numbers and try to term limit them it will be difficult. I have been a proponent of expansion this entire century but we gotta have rock solid numbers on our side.
I agree Alito will be gone, but Thomas has said in the past that he wanted to stay in the court 43 years. To paraphrase him it was something along the lines of liberals made my life hell for 43 years and now I was to make theirs the same amount of time.
I think Thomas' preference would be to continue on, but we'll see.

If Dems can get 52 Senate seats, we need to be prepared to put the fear of God into them to let SC seats sit empty for two more fucking years.

(60,841 posts)If he resigns before inauguration day, 2029. the Republicans will nominte some 38 year old ideological clone of him that will be on the Court for the next 40 years.
No new nominees until they can be nominated by the next Democratic President. If he expires prior to that, I'd have him embalmed and be there like a taxidermist's work, like he was when Scalia was around. But Trump would nominate someone like Miller, Kirk, or Rubio, and then we'd be fucked for another forty years.

Plus a confirmation process running concurrently with a divisive fall general election campaign would be on brand for Trump, and allow him to apply maximum political pressure to anyone who might waiver on his nominee. I would expect a retirement announcement soon from one of them with an early fall confirmation.
