He argues that the court just made the case for its own expansion. In case after case, lower court judges rejected Trump's executive order "revoking" birthright citizenship as absurd. So "blatantly unconstitutional," said one Reagan-appointed judge, "it boggles my mind."
The Ninth Circuit Court of Appeals also called the order unconstitutional. Another approved the class action lawsuit against it, Last adds:

"The first time the Trump administration was able to find any judge, anywhere in America, to state that it had the ability to do away with birthright citizenship was when it got to the Supreme Court.
"And then it found three of them."
