I'm no lawyer but I've heard of a legal doctrine called "clean hands" which basically says that evidence obtained by theft or fraudulent means may be suppressed by a motion of the defense as illegally obtained so it may not be presented in court as valid evidence by the prosecution. I don't know of any exceptions to this rule. Perhaps there might be one in cases involving sexual abuse of minors.
