Federal Judge Blocks Trump Administration’s DOGE Cuts After Finding It Used Race & Gender As Primary Factors - UPolitics

Federal Judge Colleen McMahon ruled that the Department of Government Efficiency‘s mass terminations of federal grants were fundamentally unconstitutional and were a textbook example of illegal viewpoint discrimination based on race and gender.

Judge McMahon’s ruling determined that the DOGE’s grant cuts were executed on the basis of race, gender, and other protected characteristics—representing a violation of both the First and Fifth Amendments. Her decision concluded that the DOGE staffers lacked the jurisdiction to make the grant terminations and blocked them from going through.

Judge McMahon said in her decision: “Treating Black civil-rights history, Jewish testimony about the Holocaust, the oft-forgotten Asian American experience, the shameful treatment of the children of Native tribes, or the mere mention of a woman as a marker of lack of merit or wastefulness is not lawful.”

She also went on to call out the decision to cut funding to projects related to the Holocaust because they focused on the experience of women during Nazi persecution, arguing that with the rise of anti-semitism, doing so is uniquely dangerous.

It’s been over a year since DOGE began mass terminations, which resulted in hundreds of thousands of Americans– disproportionately Black women– without work. It’s now 2026, and the Black unemployment rate is still raising concerns from economists.

In addition to thousands of folks losing their jobs, DOGE was also responsible for the mass cancellation of thousands of Congress-approved grants from the National Endowment for the Humanities (NEH), which U.S. District Judge Colleen McMahon has officially ruled unlawful.

What should be most concerning about the decision to people of color, McMahon also took issue with DOGE’s questionable review process, which she described as “blatant viewpoint discrimination.”
