4. If/When this lands on the SCOTUS shadow docket, they won't overrule the appellate court.

Because lack of due process at any part of their detention or proceedings is too fundamentally unconstitutional to be allowed by SCOTUS.

AND though trump has ignored the other courts, trump has done and will continue to do what SCOTUS says.
